JDC Home Solutions Terms And Conditions Agreement
The water heater you rent is fully backed by JDC Home Solutions. Our commitment, is to provide a reliable, worry-free water heater for a minimum rental term of 84 months.
Our Commitment includes:
• Service and repair of the water heater free of charge except in the following circumstances;
• If you (or any persons not authorized by JDC Home Solutions) damage the water heater, or if repairs are necessary because of alterations or use, in which the water heater was not intended.
• Installation of venting, plumbing, gas piping and/or electrical services exceeding 15 feet.
• In any circumstances described under “Customer Commitment”.
OR
• If you fail to notify JDC Home Solutions as described under “Duty to Maintain”.
• 24-hour/7 Days-A-Week contact phone number.
• A rental agreement that can be transferred to the purchaser of your residence if you decide to sell.
• A buy-out option where you may elect to purchase the water heater at any time.
• A termination option allowing you to have the water heater removed.
Customer Commitment:
We will honour our commitment and, in return, you agree that;
• You will pay your rental charges when due, as well as interest on any late payments at a rate of 1.5% per month, compounded monthly. (Your rental water heater bill will be sent to you by JDC Home Solutions on a monthly basis and your charges are due 30 days after the bill issue date.)
• We may change our rental rates from time to time by notifying customers in advance on statements, by letter, or other methods permitted by law.
• You will use the water heater safely and responsibly, and you will;
• Ensure that no combustible, hazardous or flammable materials are used or stored in the same room as the water heater.
• Ensure that the water heater is not confined to a location which makes for difficult service or removal, or where there is improper ventilation.
• Ensure that the water heater vents and openings are kept clear and clean,
AND
• Provide JDC Home Solutions with access to the water heater within reason, required for inspection, service, repair or removal.
• It is your responsibility to ensure that the water heater is located in an area with sufficient drainage, and the drain is open and unrestricted. JDC Home Solutions will NOT be responsible for damage caused if the water heater leaks. JDC Home Solutions are not the manufacturers of the water heater and make no representations, warranties or conditions as to the performance of the water heater. JDC Home Solutions will not be liable for any loss, damage or injury of any type, (including as a result of any water leakage).
• You will not allow any persons who was not authorized by JDC Home Solutions to service, repair, modify, move or disconnect the water heater, unless permitted by your buy-out option and/or termination option.
• You will be responsible for damage to the water heater caused by you or any persons unauthorized by JDC Home Solutions or by fire, flood, accident or other insurable risks.
• During the term of this agreement the water heater remains JDC Home Solutions property and you will not tamper with any tags, or stickers identifying the water heater as rented property.
• If you sell your home, you will be required to notify the purchaser that the water heater is under a rental agreement. The purchaser will then assume the rights and obligations stated in this agreement effective from the date of sale. JDC Home Solutions requires in advance the purchaser’s name and intended date of sale.
• JDC Home Solutions may inquire about your credit history.
• You agree that JDC Home Solutions may terminate this agreement and, may remove the water heater if you fail to meet any of your conditions.
Duty to Maintain:
• As the user of the water heater you are required under this agreement that the equipment is maintained in a safe operating condition. In the event any service is required please call JDC Home Solutions at 519-788-3798.
Your Buy-Out Option:
• You may purchase the water heater at any time. Price reflects remaining length of contract. You may exercise your buy-out option by notifying JDC Home Solutions by email at jdchomesolutions@outlook.com or by calling 519-788-3798.
When you exercise your buy-out option, you accept the water heater in “AS IS” condition and any of the remaining manufacturers warranty. You assume responsibility for the water heater and its repair and maintenance. You also agree to pay the buy-out price when invoiced.
Your Termination Option:
• You may terminate your water heater rental agreement at any time by notifying JDC Home Solutions by email at jdchomesolutions@outlook.com or by calling 519-788-3798.
• Depending on the circumstances there may or may not be charges to conclude the termination.
• If you choose to terminate you may do so after the full length of this agreement.
• If you choose to disconnect and/or return the water heater yourself or through any other persons, you may do so at your own risk and you agree that you will accept responsibility for all damages resulting from disconnection, removal and return or any other accident.
• If you choose to have JDC Home Solutions disconnect, remove or retrieve the water heater, there will be a $75.00 charge for these services. There is no charge if the water heater has been rented for 15 years or more.
• Your rental agreement ends upon the return of the water heater in reasonable condition reflecting it age, normal use and local conditions.
